(“IVT”, “we”, “us”, and “ours”) respects the privacy of those who it engages with through www.inventrustproperties.com and any applications owned, operated or hosted by us (collectively, the “Website”). IVT is committed to protecting your privacy by adherence to and compliance with this policy.

This Privacy Policy (the “Policy”) outlines the privacy practices of the Website which is owned by IVT. The Policy describes the types of information that may be collected or provided by those who visit the Website, and our practices of using, maintaining, protecting and disclosing that information. IVT collects certain PII, including your name, mailing address, email address, phone and fax number, and occupational information when voluntarily provided by you when you use the Website, subscribe to receive email notifications related to news and posted material, or via email you send to IVT. The personal information you submit is used by IVT to conduct ordinary business and, unless specified or prohibited, may be shared with and used by our subsidiaries and affiliates, service partners, or business partners, to provide you with information you have specifically requested or to aid us in better servicing you.

IVT may also collect certain information or data pertaining to its Website, such as the number of visitors, the date and time visited, the pages viewed, the length of time spent on each page, network location and internet protocol address (or IP address), the type of web browser and operating system, and other similar data or information. This data may be collected automatically through the use of “cookies” or other tracking technology. Cookies are small pieces of data that are placed on a user’s electronic devices each time the user visits a website. We use cookies to gather statistical data, to operate and improve website functionality, and generally enhance the website to provide a better user experience. This information helps us make the Website more useful for you. The information collected automatically, as described above, is collected primarily through our use of Google Analytics to help analyze how users use the Website. The safety and security of your information is important to us. Unfortunately, transmission of information using the internet is not completely secure. Although we do our best to protect your PII, we cannot guarantee, ensure, or warrant the security of any information you transmit to us. There is no guarantee that information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. Please note that e-mails and other submissions and communications you send to us through the Website are not encrypted, and we strongly advise you not to communicate any confidential information through these means. We will not be responsible or liable for any damages, losses or causes of action arising out of or in connection with the disclosure of your personally identifiable information.    

Tenants

In the Tenant Resources section of the Website, tenants are provided with online resources and information specific to shopping center businesses; are able to submit updated Certificates of Insurance; and can access tenant billing information, open disputes and inquiries, and pay tenant invoices through the Tenant Portal system which is administered by one of our third party service providers. The information collected in connection with the foregoing services may contain your PII and is used for the purpose of providing services to you and/or any permissible use by IVT, in accordance with your Lease and applicable law. PII collected in connection with tenant rent payments, including bank account and/or credit card information, is governed by the privacy policy and any applicable terms of use in effect by the respective third party service provider.

Investors

Visitors to the Website are able to request email notifications and other information. In order to make this request, visitors are required to provide PII, including but not limited to, name, telephone, email address and mailing address. The Investor portion of our Website is currently managed by one of our third party service providers. Information collected in this portion of the Website is used to comply with any information requested and is governed by the privacy policy and any applicable terms of use in effect by the respective third party service provider.

Accessing and Updating Your Information

Rights and Choices/Opt-Out

You may have the right to access and review your PII collected on the Website by IVT, and if the information is inaccurate, request that the information be corrected or updated. In some instances, you may also request that certain PII be deleted provided, that, such requests are not prohibited by applicable law. IVT will make reasonable efforts to comply with such opt-out or deletion requests and reserves the right to verify the requestor’s identity before any such requests are processed. You understand that any such opt-out or deletion requests may affect IVT’s ability to provide you with certain services and/or information you have specifically requested.

Rights Under the California Consumer Privacy Act (“CCPA”)

If you are a California resident, the CCPA grants you with the following consumer rights over your personal information, provided an exemption is not recognized under California law.

  • The right to obtain (free of charge) a copy of the personal information a business collects about you for the 12-month period preceding your request, together with how the personal information is used and disclosed.
  • The right to have your personal information deleted (in certain circumstances).
  • The right to opt-out of the selling of your personal information (where applicable by law).
  • The right of non-discrimination for exercising your rights under the CCPA.

We aim to process all verified requests within forty-five (45) days pursuant to the CCPA. If necessary, extensions for an additional forty-five (45) days will be accompanied by an explanation for the delay. Our Website contains links to third party websites. These third party websites are operated by companies that IVT does not own or control. Any visitor that links to a third party website does so at their own risk, and any such activity is no longer subject to the terms of this Policy. Transfer in the Event of Sale or Change of Control

In the event ownership of all or substantially all of IVT’s business or assets are sold or otherwise transferred to a third party, IVT may transfer the information collected to the new owner for use consistent with the Policy. Unless prohibited by applicable law, all information transferred would remain subject to the Policy unless otherwise agreed by you.

Information Disclosure

IVT may disclose PII with any third-party company, organization or individual outside of IVT, if it is believed that such disclosure is reasonably necessary to:

Children Under the Age of 13

Our Website is not intended for children under 13 years of age. We do not intentionally solicit, collect, use or retain PII from children under 13 years of age.
